JETS INTEL TERMS OF USE

1. INTRODUCTION & ACCEPTANCE

These Terms of Use ("Terms") govern your access to and use of the Jets Intel website (jetsintel.com) and its services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

2. DEFINITIONS

a. "Jets Intel" means the owner and operator of jetsintel.com.

b. "User" or "you" means any individual who accesses or uses the Services.

c. "Content" means all information, data, text, images, and other materials available through the Services.

d. "Subscription" means paid access to premium features and data.

e. "Authorized Users" means individuals who have been granted access to subscription features by a paying subscriber.

3. SERVICES DESCRIPTION

Jets Intel provides a platform displaying information about private jets listed for sale, including asking prices, estimated sold prices, technical characteristics, and images. Users may generate reports from this data for personal, non-commercial use only and subscribe to email alerts.

4. RESTRICTIONS ON USE

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

a. Use the Services for any commercial purpose without prior written permission from Jets Intel;

b. Copy, reproduce, distribute, modify, or create derivative works based on the Content;

c. Scrape, data-mine, or extract substantial portions of the Content;

d. Attempt to gain unauthorized access to any portion of the Services;

e. Share your account credentials with others or allow others to access your account;

f. Use the Services to create a competing product or service;

g. Export data in mass form or import data into any other form or system without explicit permission;

h. Attempt to circumvent any restrictions on data export or usage;

i. Use the Services in any manner that infringes upon the intellectual property rights of Jets Intel or any third party.

5. SUBSCRIPTIONS & AUTHORIZED USERS

a. Jets Intel offers subscription options that provide access to additional data and features.

b. Subscription fees are non-refundable except as required by law.

c. Subscribers may only use the Services for their own internal purposes and may not resell or redistribute the Content.

d. If a subscription specifies a number of Authorized Users, access is limited to that number of users. User credentials cannot be shared or used by more than one individual.

6. OWNERSHIP & INTELLECTUAL PROPERTY

a. All Content, including but not limited to text, graphics, logos, and data compilations, is the property of Jets Intel or its licensors and is protected by copyright and other intellectual property laws.

b. Jets Intel grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

7. ACCURACY OF INFORMATION

a. Jets Intel strives to provide accurate and reliable information. However, the information is gathered from various sources by Jets Intel researchers, and Jets Intel does not guarantee the accuracy, completeness, or reliability of any Content.

b. Asking prices and estimated sold prices displayed on the Services may vary from actual transaction prices. Users must independently verify all information with the sellers before making any decisions.

c. Jets Intel is not a broker or seller of aircraft and only facilitates research and communication. All transactions must be conducted directly with the sellers.

d. Users acknowledge that the Services are provided "AS IS" and rely on the Content at their own risk.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. JETS INTEL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. LIMITATION OF LIABILITY

a. IN NO EVENT SHALL JETS INTEL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

b. Jets Intel shall not be liable for any loss or damage arising from your reliance on information obtained through the Services.

c. Jets Intel's total liability for any claims arising under these Terms shall not exceed the amount paid by you, if any, to Jets Intel for access to the Services during the twelve (12) months prior to the claim.

10. COMMUNICATIONS CONSENT

By using the Services, you consent to receive communications from Jets Intel, including but not limited to emails regarding your account, updates to the Services, inquiries and promotional materials. You may opt-out of promotional communications at any time by writing to info@jetsintel.com or in the web app, where it is possible.

11. MONITORING AND ENFORCEMENT

a. Jets Intel reserves the right to monitor use of the Services to ensure compliance with these Terms.

b. Jets Intel may, in its sole discretion, suspend or terminate your access to the Services for any actual or suspected violation of these Terms.

c. You agree to cooperate with Jets Intel's reasonable investigations of service outages, security problems, or any suspected breach of these Terms.

12. TERM AND TERMINATION

a. These Terms shall remain in effect until terminated by either you or Jets Intel.

b. Upon termination, all rights granted to you under these Terms will immediately cease, without reimbursement.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the English law, without regard to its conflict of law provisions.

14. MISCELLANEOUS

a. Jets Intel may modify these Terms at any time by posting the revised Terms on the website. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

b. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

c. Jets Intel's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

d. These Terms constitute the entire agreement between you and Jets Intel regarding the Services and supersede all prior agreements and understandings.
